I. OWNERSHIP OF THE PORTAL
RAIN FOREST VALENCIA, SA (onwards, BIOPARC VALENCIA) with registered office at C/ Padilla, 26 – 4ª 28006 MADRID (Madrid) SPAIN, CIF A83110197 and registered in the Commercial Registry of MADRID T 16879, F 135, S 8, HM 288596 is the owner of the domain bioparcvalencia.es, as well as the portal and its contents (hereinafter, the “Portal”) and makes it available to Users, in order to provide them with information about BIOPARC VALENCIA products and offers, as well as to allow the provision of different ticket purchase services or any other type of products through the Portal as well as, where appropriate, make available to Users, information related to the different contact forms, newsletters, contests, games, surveys, etc. of BIOPARC VALENCIA.
Without prejudice to the foregoing, the contracting of the different products and services offered through this Portal will be carried out by RAIN FOREST VALENCIA, SA, which operates through the Portal and is the owner of the management of BIOPARC VALENCIA, and is therefore responsible for the sale and/or management of all products and/or services related to BIOPARC VALENCIA.

II. GENERAL CONTRACTING CONDITIONS
These general contracting conditions will expressly regulate the relationships arising between BIOPARC VALENCIA and the Users who contract the provision of services or products offered through the Portal (hereinafter, the "General Contracting Conditions").
These General Terms and Conditions have been drawn up in accordance with the provisions of Law 34/2002, of July 11, on information society services and electronic commerce, Law 7/1998, of April 13, on General Terms and Conditions, Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 6/2020, of November 11, regulating certain aspects of trusted electronic services and any applicable legal provisions.
These General Terms and Conditions are accessible at all times in the online purchasing section of the BIOPARC VALENCIA Portal and may be printed and/or stored by the User.
1. PRE-CONTRACT INFORMATION
These General Terms and Conditions of Contract are intended to regulate the general conditions for the provision of services offered by BIOPARC VALENCIA through the Portal and, in particular, the services currently provided by BIOPARC VALENCIA and contracted by Users, the sales service for certain types of tickets and season passes for parks managed by RAIN FOREST VALENCIA, SA, as well as, where applicable, other products offered through the Portal.
The sale of tickets and season passes for BIOPARC VALENCIA, as well as any other products offered through the Portal, is chargeable. The price of each product (including taxes) in euros, as well as any applicable promotions and discounts, will be those determined at any given time on the Portal. At the time of purchase, the Portal will indicate the total price, detailing, where applicable, any increases or discounts/promotions applied, any expenses charged to the User, and any additional costs for ancillary services or the use of different payment methods.
Access to the information contained on the Portal is not subject to any payment.
The User understands that the information contained on the Portal, the general information on the product catalog, as well as other products or services offered on the Portal, and the General Terms and Conditions of Contract and the conclusion of the contract, are sufficient to exclude errors in the formation of consent.
1.1 Procedures
To proceed with the use of the different purchasing services offered on the Portal, the User must follow all the indications and instructions included at each stage of the purchasing process on the screens used for this purpose, completing for this purpose the information required by the forms posted on the Portal, which will imply the prior reading, understanding and acceptance of all the General Conditions of Contract and specific conditions set forth therein, such that the User declares to know and accept said procedures as necessary to access the products and services offered in the PURCHASE section of the Portal.
The User's rights and obligations, both during and after the acquisition of products and services, are also subject to the provisions set forth in these General Terms and Conditions, the general terms and conditions of use of the Portal and the corresponding Specific Terms and Conditions, as well as the operating rules.
The User will formalize their purchase by completing all the steps established in the PURCHASE section and submitting it electronically. These General Terms and Conditions, along with any corresponding Specific Terms and Conditions, will become part of the contract with the User upon express acceptance by the User, as expressed by completing and submitting the purchase information entered in the PURCHASE section.
Access to the Portal and use of any of the Portal's services implies acceptance by the User, without reservation of any kind, of each and every one of the General Conditions of Use of the Portal, as well as the General Conditions of Contract and, where applicable, the Specific Conditions of Contract that, made available to the User prior to formalizing their purchase, govern the acquisition of tickets or season passes and/or any other products and services offered through the Portal at any given time.
The User declares that they have the necessary legal capacity to be bound by these General Terms and Conditions, as well as to use and, where applicable, enter into contracts through the Portal, in accordance with the Specific Terms and Conditions applicable in each case. Regarding all of these Terms and Conditions, the User declares that they are aware of, understand, and accept them in their entirety. The User shall use the products purchased, whether for their own consumption or for third parties, under their own responsibility.
1.2 Documentation and language
These General Terms and Conditions are accessible at all times in the online Purchase section of the BIOPARC VALENCIA Portal and may be printed and stored by the User.
In the case of the purchase of tickets, once the purchase process is completed, the User will receive, within the period of twenty-four (24) hours or the legal period that is applicable at that time, via email a receipt of purchase (the "Ticket”) with a unique code (barcode) that will be the entrance to the amusement park grounds. This ticket, if printed, may not be tampered with or damaged, as it would be immediately invalidated.
Unless expressly stated otherwise, tickets purchased through the Portal for a specific date will be valid only for that date.
In the case of the purchase of season passes or any other products and/or services offered through the Portal other than the purchase of tickets, the User will also receive, within the following twenty-four (24) hours or the legal period applicable at that time, via email the purchase receipt (also referred to as "Ticket"). Likewise, the Portal will inform you of the Specific Contract Conditions for the aforementioned products or services prior to contracting them.
With the issuance of the Ticket, all requirements for providing the invoice replacement document are deemed to have been met, in accordance with Royal Decree 1619/2012, of November 30, which approves the Regulation governing invoicing obligations.
Once the purchase process made available through the Portal has been completed and the corresponding Ticket has been obtained, changes or returns will not be accepted except in the cases expressly stated in the Specific Contract Conditions and/or provided for in the applicable regulations, and the User may contact the reservations department. info@bioparcvalencia.es
These General Terms and Conditions are written in Spanish, and the purchasing process will be conducted in that language.
1.3 Technical means
The Portal will provide the User with all the necessary technical means to identify and correct errors when entering their data into the various forms that appear on the screen during the purchasing process.
1.4 Modification of the General Contracting Conditions
These General Terms and Conditions of Contract are in force as of the date of their last update (indicated at the end of this document). BIOPARC VALENCIA reserves the right to modify these General Terms and Conditions of Contract or, where applicable, the Specific Terms and Conditions of Contract that may be applicable, at any time, in accordance with the requirements of good faith, balance, and transparency, as well as any other general or specific terms and conditions, regulations of use, or notices that may be applicable. In this case, they will enter into force upon publication and will apply exclusively to users who access the Portal after the aforementioned date. For clarification purposes, in the event that these General Terms and Conditions of Contract are modified, in strict compliance with the regulations applicable to the protection of consumers and users, BIOPARC VALENCIA will respect the commitments and agreements acquired with users prior to the aforementioned modification that are applicable.
In any case, before purchasing products or services, you may always consult the General Terms and Conditions and, where applicable, the applicable Specific Terms and Conditions. Furthermore, the Portal reserves the right to modify the presentation, configuration, and location of the Portal, as well as the content and conditions required for its use, at any time.
1.5 Exchanges and returns. Right of withdrawal
Unless expressly stated in the Specific Contract Conditions of the product or service purchased, no exchanges or returns will be accepted for products that have a specific date - or a specific period - for their enjoyment, in accordance with the provisions of article 103.l) of Royal Legislative Decree 1/2007, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws.
That is to say, the right of withdrawal does not apply to this type of product, given the nature of the product.
1.6 Price and payment method.
The price of the products selected by the user is reflected prior to purchase and includes taxes.
The price is displayed prior to purchase and once the User has added all the products they wish to purchase. It includes all applicable taxes.
The payment methods accepted by the Portal are: -subject to the limitations established in the applicable regulations- debit or credit bank cards.
BIOPARC VALENCIA guarantees that it has appropriate measures in place and that these comply with the security standards permitted by current technology, such as the Verisign system. Access to transactional services and those that include the capture of personal data is carried out in a secure environment using the SSL (Secure Socket Layer) protocol with high-security 128-bit encryption. The secure server establishes a connection so that the information is transmitted encrypted. This ensures that the transmitted content is only intelligible to the "client" computer and the BIOPARC VALENCIA server. The User can verify that they are within a secure environment if a closed padlock appears in their browser's status bar.
In its commitment to fraud prevention, BIOPARC VALENCIA will collaborate with both the payment platforms used for the purchase of products through the Portal and the competent authorities, providing information on any transaction that may be necessary, always in compliance with current legal requirements.
Finally, BIOPARC VALENCIA is not responsible for the content of websites that the user may access through links on its website and declares that under no circumstances will it examine or exercise any type of control over the content of other websites on the Internet. Likewise, it does not guarantee the technical availability, accuracy, truthfulness, validity, or legality of websites not owned by it that may be accessed through links.
1.7 Incorporation of the Specific Contracting Conditions and the Operating Rules of the Park
The purchase and use of any Product through the Portal implies acceptance of the General Terms and Conditions, the Specific Terms and Conditions applicable to the Products and services purchased, and the Park's operating rules, which can be found in the operating rules. Please read them carefully before proceeding with your purchase.
2. PROCEDURE FOR HANDLING CLAIMS
To enable the User to effectively file a claim in the event of an error, defect, or deterioration, as well as to enforce the quality or service guarantees offered, and, where applicable, obtain a fair refund if a breach or defective performance by BIOPARC VALENCIA has actually occurred, the User may address their claim to:

Likewise, the User as a consumer may request an out-of-court dispute resolution, in accordance with Law 7/2017, of November 2, which incorporates into Spanish law Directive 2013/11/EU of the European Parliament and of the Council of May 21, 2013, on alternative dispute resolution in consumer matters.
3. BIOPARC VALENCIA VISITING RULES
· You must always follow the instructions given by BIOPARC VALENCIA staff; they strive to ensure everything runs smoothly.
· Food and drinks are not allowed, except for water in non-glass containers.
· You are not permitted to leave and re-enter BIOPARC VALENCIA unless you purchase a new ticket or, in exceptional cases, are authorized by BIOPARC VALENCIA staff.
BIOPARC is a smoke-free space, including the terraces. Please check the smoking areas.
· Bicycles, skates, skateboards, scooters, balls, balloons, etc. are not allowed.
· Respect the surroundings and fenced areas. Trespassing is prohibited.
· Feeding the animals is prohibited. Respect their tranquility. Do not touch them or throw objects at them, bang on the glass, or use a flash to photograph them. The animals do not respond to these stimuli.
· Pets of any kind are not permitted at BIOPARC VALENCIA, except for guide and assistance dogs, provided they present the appropriate accreditation. See conditions at www.bioparcvalencia.es
· BIOPARC Valencia has wheelchairs available for emergency use only.
Minors under 14 years of age must be accompanied at all times by a legal guardian. BIOPARC VALENCIA may request documentation proving that the adult is the legal guardian of the minor. Minors over 14 years of age may visit BIOPARC VALENCIA without being accompanied by an adult, provided they present the required documentation. See conditions at www.bioparcvalencia.es
· Visiting the park with your torso uncovered is not permitted.
For biological reasons, certain facilities may remain closed, and some animals may not be present in the exhibit area. Activities at BIOPARC VALENCIA and their schedules are subject to change.

· Due to weather conditions, the ticket price will never be refunded.
· Running or any activity that might disturb park visitors is prohibited.
· BIOPARC VALENCIA is not responsible for any damage or harm caused by non-compliance with these rules or improper use of the facilities.
· BIOPARC VALENCIA reserves the right of admission, in accordance with the provisions of the legal system and particularly in the following cases:
· Management reserves the right to apply these rules or any other necessary regulations at any time to ensure animal welfare and the safety of park visitors and staff.
